General provisions

1.    This document sets out the rules for the processing and protection of personal data of Customers of the Service available at eu.loftlight.pl (Privacy Policy).

2.    The Controller of personal data of Customers within the meaning of the OODO Act is
Bottonova sp. z o.o. with its registered office in Wrocław at ul. Robotnicza 64, entered in the register of entrepreneurs maintained by the District Court for Wrocław-Fabryczna, VI Commercial Division, under KRS number 140560, share capital: PLN 100,000.00, NIP: 897-160-68-67, REGON: 931994244,
e-mail: biuro@loftlight.pl – hereinafter referred to as the Service Provider.
The Service Provider processes personal data in accordance with the applicable provisions of Polish law and respects the privacy principles of Customers provided for in the OODO Act.

3.    Definitions – The terms used in the Terms and Conditions and the Privacy Policy are set out at the end of this document.

Scope and purpose of collected data

4.    This Privacy Policy applies to personal data processed in the Service in order to enable the use of the Service’s functionalities, including data collected automatically during visits to the Service, in particular:
a. for the purpose of Registration in the Service;
b. for the purpose of placing and fulfilling an Order, as well as for the proper operation of the Online Store, including data collected automatically during visits to the Online Store.

5.    For the purpose of fulfilling an Order, the Service Provider collects the following data: first and last name, address (street, house number, city with postal code), contact telephone number, or other data provided by the Service Provider in the Service or during contact with the customer.

6.    For the purpose of registering a customer account in the Service, the following data are collected: first and last name, e-mail address, password, contact telephone number.

7.    The Service Provider declares that providing data marked in the Service as required is voluntary but necessary to use selected functionalities of the Service, including, in the case of data indicated in points 6–7 above, for fulfilling an Order or registering a customer account.

8.    Personal data of Customers collected to enable the use of functionalities available in the Service are processed by the Service Provider for the purpose of:
a) handling the process of Registration and logging into the customer account,
b) selling products to Customers and delivering them,
c) possible claims,
d) clarifying cases of unlawful use of services provided electronically,
e) creating reports and analyses for the Service Provider regarding the functioning of the Service, including page view statistics,
f) adapting the Service to Customers’ needs.

9.     Regardless of the above, if the Customer gives separate consent, the Customer’s personal data are processed by the Service Provider for the purpose of receiving commercial information, in particular for sending the ordered newsletter to the e-mail address indicated by the Customer.

10.   The Service Provider informs that during the use of the Service, data concerning the Customer are also collected automatically. Such data may be collected in the Service’s system logs, through Cookies and by Google Analytics services – within the framework of services provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). These services help the administrator analyze traffic in the Online Store.

11.  The Service Provider uses Cookies in order to collect information related to the Customer’s use of the Service. Cookies are IT data, in particular small text files, saved and stored on devices through which the Customer uses the Service, which allow:
a. maintaining the Customer’s session (after logging in), so that the Customer does not have to re-enter login and password on each subpage,
b. creating statistics of subpage views,
c. personalizing marketing messages,
d. ensuring security and reliability of the Service.

The Service uses both session Cookies, which are deleted after closing the browser window, and persistent Cookies, saved for a specified time on the devices used to access the Service.
The Customer may independently and at any time change Cookie settings, specifying the conditions of their storage and access. These settings can be changed via the browser settings or service configuration, in particular to block automatic Cookie handling or to notify the Customer each time Cookies are placed. Detailed information is available in the browser software settings. The Customer may also delete Cookies at any time using the available functions in the web browser used.
Limiting the use of Cookies may affect some functionalities available in the Service.

We cooperate with RatingCaptain, a tool used to study the satisfaction of our customers with our services/products. As part of this cooperation, we may ask you to complete a survey or provide a review of our products/services. Additionally, RatingCaptain processes data regarding your activity in our Service (visited subpages, time of visit, clicks, use of services/viewed products), as well as information about the end device or browser, including its location. We have entered into an appropriate data processing agreement with RatingCaptain. Your data will not be profiled using RatingCaptain. You may withdraw your consent at any time by sending a message to our contact address indicated in the section “Our contact details and your rights.”

Rights and obligations of the Service Provider

12.  The Service Provider reserves the right to disclose selected information concerning the Customer to competent authorities or third parties who request such information on the basis of an appropriate legal ground, in accordance with applicable law.

13.  The Service Provider declares that it entrusts the processing of Customers’ personal data or other data referred to in the Privacy Policy, on the basis of a written agreement concluded in accordance with art. 31 of the OODO Act, to entities providing hosting, administration, maintenance and management of the Service, as well as services in the field of communication optimization and campaign management.

14.  The Service Provider declares that it entrusts the processing of Customers’ personal data or other data referred to in the Privacy Policy to other entities providing services to the Service Provider or directly to the Customer, as necessary to use the Service, including fulfilling an Order, handling complaints, and using financial services available in the Online Store, on the basis of a written agreement concluded in accordance with art. 31 of the OODO Act. Customers’ personal data may in particular be entrusted to Product suppliers and financial institutions intermediating in the payment process for the Order.

Rights and obligations of the Customer

15.  Each Customer has the right to access their personal data, the right to correct, supplement, request cessation of processing, and the right to deletion of data. To do so, please send an e-mail to: biuro@loftlight.pl or use the functionalities provided in the Service.

16.  In cases where the Service Provider requests consent to send commercial information electronically (e.g. by e-mail), the person who has given such consent has the right to withdraw it. To do so, please:
a) send an e-mail to: mateusz@loftlight.pl with the subject line “newsletter resignation”
b) click on the link withdrawing consent included in the commercial information
c) send a written statement of withdrawal of consent to receive commercial information to the Service Provider’s address.

17.  If the Customer provides any personal data of other persons in the Service (including their name, address, telephone number or e-mail), this may be done only on condition that the applicable law and personal rights of such persons are not violated.

Data security

18. The Service Provider declares that it makes every effort to ensure a high level of security for Customers in using the Service. All events affecting the security of information and data transmission, including suspected sharing of files containing viruses or other destructive mechanisms, should be reported to the Service Provider at: biuro@loftlight.pl

Definitions


Product – Goods presented in the Online Store, being the subject of a sales agreement.

Registration – A one-time action consisting of creating a Customer Account, performed by the Customer and/or at the Customer’s request using the tools provided in the Service.

Service – All functionalities made available by the Service Provider at www.loftlight.pl

Online Store – A functionality of the Service through which an Order may be placed (Products purchased).

Order – A Customer’s declaration of intent directly aimed at concluding a distance sales agreement via the Online Store, specifying the type and/or number of Products.
